Terms of use
The German version of these terms is the legally binding one. This English version is provided for your convenience.
1. Who we are and what this is about
PageBite is an app by Henri Irmscher — Appentwicklung, Seckbacher Landstr. 66, 60389 Frankfurt am Main, Germany (imprint). These terms govern the use of the app between you and us. How we handle your data is described in the privacy policy.
2. What PageBite does
- You scan pages from books you read.
- The app reads the text on your phone. An AI creates a key idea, a quiz and flashcards from it.
- The app plans daily reviews of your flashcards. Reviewing also works offline.
- Your cards are backed up with your account and kept in sync between your devices.
3. AI content can contain errors
- Key ideas, quiz questions and flashcards are created by an AI. They are marked "AI-generated" in the app.
- AI content can be wrong, inaccurate or incomplete. If in doubt, check it against the original text.
- The content is a learning aid. It does not replace professional advice, for example in medicine, law or finance.
- We don't promise any particular learning result. It depends on how you learn.
4. Minimum age
You must be at least 16 years old to use PageBite. If you are under 18, you need the permission of a parent or guardian before you buy.
5. Account
You don't have to register. The app creates an anonymous account on first use. Optionally, you can add an email address to sign in on other devices. Make sure only you have access to that email address.
6. Your content stays yours
- The app is a technical tool. You trigger every scan, text recognition and analysis, and they then run fully automatically. We neither select nor review or edit the content you capture.
- Only scan single pages from works you are allowed to use, for example from your own copy, and only for private use in the sense of § 53(1) of the German Copyright Act. Learning for school, training or university is included.
- Not allowed are, in particular, capturing a book or magazine essentially in full (§ 53(4) UrhG), using a copy that was obviously made or made available unlawfully, and any use for professional or commercial purposes.
- Circumventing effective technical protection measures, such as the copy protection of an e-book, is not allowed (§ 95a UrhG). The app is meant for printed pages.
- The cards you create are for your personal use only. Distributing them or making them available to the public is not allowed (§ 53(6) UrhG).
- All rights in your content remain with you or the respective rights holders.
- You allow us to process your content as far as the app needs it: to send the recognized text to the AI and to store and sync your cards. We don't use your content for anything else.
Report an infringement: If you believe that content stored through PageBite infringes your rights, please report it to henri.irmscher@gmail.com. Tell us which content it is and what your right is based on. We review every report, remove infringing content expeditiously and tell you the outcome.
7. What you are responsible for
- Use PageBite lawfully and without infringing the rights of others.
- Don't bypass technical limits, for example the weekly limit or the subscription check.
- Don't attack the app or our servers, and don't send automated mass requests.
8. Fair use: up to 240 scans a week
PageBite processes up to 240 scans in 7 days with the AI per account. One scan is 1 to 5 pages that you scan at once. We count the scans of the last 7 days, today included (days in UTC), so scans free up again day by day. Pages above the limit stay saved on your phone and are processed automatically as soon as scans free up and the app is open. The limit protects against abuse and keeps costs fair for everyone.
9. Subscription, prices and cancellation
- On first use you can scan one page for free. After that, PageBite can only be used with an active subscription. Without one, data export, account deletion, restoring purchases and the legal pages remain available.
- There is a yearly plan and a monthly plan. You see the prices in the app and in the store before you buy. They include statutory VAT.
- The yearly plan can include a free trial. You see its length in the app and in the store before you buy. If you don't cancel before it ends, the paid yearly plan starts.
- You buy and pay through Apple's App Store or Google Play. Their terms apply in addition.
- The subscription renews automatically for the same period unless you cancel in time. In the App Store, you must cancel at least 24 hours before the end of the period.
- You cancel in the subscription settings of your App Store or Google Play. Deleting the app or your account does not cancel the subscription.
- After your subscription ends, your data is kept, but the app is locked except for the areas listed above.
Right of withdrawal and refunds
You make the purchase with Apple or Google. Their terms therefore apply to your right of withdrawal and to refunds.
10. Availability
We work to keep PageBite reliable. Maintenance, outages at service providers or a missing internet connection can temporarily prevent AI processing or syncing. Scanned pages then stay on your phone and are processed later.
11. Liability
- We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and where we have given a guarantee.
- For slight negligence, we are only liable if we breach an essential contractual obligation. These are obligations you may rely on because they make using the app possible in the first place. Liability is then limited to the foreseeable, typical damage.
- Otherwise, liability is excluded.
12. Termination
You can delete your account at any time in the app: Settings → Delete account. We may block or delete your account for good cause, for example for serious breaches of these terms. We inform you beforehand where possible.
13. Changes to these terms
We may change these terms if the app, the law or our service providers change. Changes only apply to the future. We don't change essential parts of the contract, for example the price and scope of your current subscription, without your consent. If you don't agree with a change, you can cancel your subscription and delete your account.
14. Governing law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection rules of the country you live in remain unaffected.
15. Dispute resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. If you have a problem, simply write to henri.irmscher@gmail.com.
16. Final provisions
- If you download PageBite from the App Store, Apple's Licensed Application End User License Agreement also applies. Apple and Google are not parties to these terms and are not responsible for the app or its support.
- If any provision is invalid, the remaining provisions stay valid.
